Widow of Late All That Remains Guitarist Oli Herbert Says You Weren’t Meant to Hear That Eurythmics Cover

Earlier today, Moroni Silva, of the band A Dead Desire, contacted MetalSucks. A Dead Desire, you see, has a new cover of the Eurythmics song “Here Comes the Rain Again,” which includes a guest appearance by late All That Remains guitarist Oli Herbert — one of his last recordings before his untimely death this past October. Silva told us that “Oli was a good friend and wanted to release the song at the start of the rain season, so it was released on the New Moon of the 5th of this month and dedicated to him.” Naturally, we helped spread the word by posting the song.

Unfortunately, Oli’s widow, Elizabeth Herbert, has now taken to her late husband’s Facebook page to say you weren’t meant to hear this recording (screenshot here if it gets yanked down):

“I am aware that something was released that contained my husband’s work on it that was not finished before his death. To be clear, if anything is to be released after Oli’s death and it isn’t All That Remains material, you need me, the executrix of the estate to sign off on it. Also, probate was not opened until this year so any arrangements after my husband’s death for his material but before I was named executrix is unenforceable.”

The last part of that statement doesn’t really make any sense — it would logically follow that Silva and A Dead Desire made “arrangements” for this song before Oli’s death (since he’s, y’know, on the track), and, therefore, before Beth was executrix of his estate. There may be some legalities I’m not understanding here, but it’s hard to imagine Oli disapproving of a very recent recording of his being released — especially one he made with a buddy, as is the case here.

Regardless, it’s hard to take Beth at her word. Last we heard, police are investigating Oli’s death as “suspicious,” not least of all because just a week before his death, he reportedly signed a new will naming Beth as the sole executor and beneficiary of his estate… and had that new will notarized at a Hartford car dealership by a friend of the Herberts, with no review by an attorney. Add to that ATR frontman Phil Labonte’s recent comment that Beth is a “garbage human being” who the band had hoped Oli would divorce, and… well…

But hey, look. It doesn’t matter what I think. If Silva released the track illegally, it will get yanked down any second now. If Silva did not violate any laws by releasing the track, it will remain up, regardless of what Beth says or wants. So that will settle that.
